196. Tajwizaat ko pesh karne ka aur oonko manzuur karne ke usul.—
Provisions as to introduction and passing of Bills.—

196(1). Maali Tajwiiz aur digar maaliyaati Tajwizaat ke mutalliq mazaameen 198 aur 207 ke usul ke tehat rehte hue, kisi bhi Tajwiiz ki ibteda jin Riyaasat me Riyaasati Shura hae waha ki Qaanuun-saaz Majlis ke dono me se kisi bhi Aewaan me ho sakti hae.
Subject to the provisions of articles 198 and 207 with respect to Money Bills and other financial Bills, a Bill may originate in either House of the Legislature of a State which has a Legislative Council.

196(2). Mazaameen 197 aur 198 ke usul ke tehat rehte hue, kisi bhi Tajwiiz ko oos waqt tak jin Riyaasaat me Riyaasati Shura hae oski Qaanuun-saaz Majlis ke donohi Aewaan se manzuur shuda nahi maana jaayega, jab tak ke oos Tajwiiz ko donohi Aewaan ki manzuuri naa mil jaaye, aur manzuuri ya tou baghaer kisi tarmiin ke hou ya utni hi taraamiin ki had tak hou jitni taraamiin par donohi Aewaan muttafiq ho.
Subject to the provisions of articles 197 and 198, a Bill shall not be deemed to have been passed by the Houses of the Legislature of a State having a Legislative Council unless it has been agreed to by both Houses, either without amendment or with such amendments only as are agreed to by both Houses.

196(3). Riyaasat ki Qaanuun-saaz Majlis me koi bhi Tajwiiz jo zere ghaur ho tou oose Aewaan ke multawi kiye jaane ki bina par radd nahi maana jaayega.
A Bill pending in the Legislature of a State shall not lapse by reason of the prorogation of the House or Houses thereof.

196(4). Kisi Riyaasat ke Riyaasati Shura me koi bhi Tajwiiz jo zere ghaur ho aur jise Aewaan e Awaam ne manzuur nahi kiya huwa ho tou oose Aewaan e Awaam ka ikhtetaam ho jaane ki bina par radd nahi maana jaayega.
A Bill pending in the Legislative Council of a State which has not been passed by the Legislative Assembly shall not lapse on a dissolution of the Assembly.

196(5). Riyaasati Majlis me koi bhi Tajwiiz jo zere ghaur ho, ya jise Riyaasati Majlis ne manzuur kar liya ho par wo Riyaasaati Shura me zere ghaur ho, tou Riyaasati Majlis ka ikhtetaam ho jaane par oose radd maana jaayega.
A Bill which is pending in the Legislative Assembly of a State, or which having been passed by the Legislative Assembly is pending in the Legislative Council, shall lapse on a dissolution of the Assembly.

197. Maali Tajwiizaat ke alaawa digar Tajwiizaat ke mutalliq Riyaasati Shura ke ikhteyaaraat ke hudud.—
Restriction on powers of Legislative Council as to Bills other than Money Bills.—

197(1). Jis Riyaasat me Riyaasati Shura ho agar oos Riyaasat ki Riyaasati Majlis koi Tajwiiz ko manzuur karde aur ooske baad Riyaasati Shura me muntaqil karde, fir— 
If after a Bill has been passed by the Legislative Assembly of a State having a Legislative Council and transmitted to the Legislative Council— 

197(1a). Shura oos Tajwiiz ko na-manzuur kar de; ya 
the Bill is rejected by the Council; or

197(1b). jis taarikh ko Tajwiiz ko Shura ke saamne pesh kiya gaya tha oos taarikh se tiin maah se zaaid ka muddat guzar chuki ho aur Shura ne oos Tajwiiz ko tab tak manzuur nahi kiya ho; ya
more than three months elapse from the date on which the Bill is laid before the Council without the Bill being passed by it; or

197(1c). Shura ne oos Tajwiiz ko aesi taraameem ke saath manzuur kiya ho jin par Riyaasati Majlis raazi na ho;
the Bill is passed by the Council with amendments to which the Legislative Assembly does not agree;

tou, Riyaasati Majlis chaahe tou, ooske tariqe ki nizaamat karte qawaaiid ke tehet rehte huwe, Tajwiiz ko oosi ijlaas me ya baad ke kisi ijlaas me, Riyaasati Shura ki, ki hui, ya ooski mashwara di hui ya jispar bhi Riyaasati Shura ne raza di thi, aesi taraameem ke saath ya aesi taraameem ke baghaer hi Tajwiiz ko manzur kar sakti hae, aur fir oos Tajwiiz ko oski manzuur shuda haalat me Riyaasati Shura me muntaqil kar sakti hai.
the Legislative Assembly may, subject to the rules regulating its procedure, pass the Bill again in the same or in any subsequent session with or without such amendments, if any, as have been made, suggested or agreed to by the Legislative Council and then transmit the Bill as so passed to the Legislative Council.

197(2). Agar is tarha se Tajwiiz ko Riyaasati Majlis ne dobaara manzuur kar liye ho aur oos Tajwiiz ko Riyaasati Shura me muntaqil kar diya hou, aur—
If after a Bill has been so passed for the second time by the Legislative Assembly and transmitted to the Legislative Council—

197(2a) Riyaasati Shura ne Tajwiiz ko na-manzuur kar diya; ya
the Bill is rejected by the Council; or

197(2b) jis taarikh ko Tajwiiz ko Shura ke saamne pesh kiya gaya tha oos taarikh se ek maah se zaaid ki muddat guzar chuki ho aur Shura ne oos Tajwiiz ko tab tak manzuur nahi kiya ho; ya
more than one month elapses from the date on which the Bill is laid before the Council without the Bill being passed by it; or

197(2c). Shura ne Tajwiiz ko aesi taraameen ke saath manzuur kiya ho jinpar Riyaasati Majlis raazi nahi ho;
the Bill is passed by the Council with amendments to which the Legislative Assembly does not agree;

tou, Tajwiiz ko Riyaasat ki Qaanuun-saaz Majlis se manzur shuda maana jaayega oos haalat me jaesa ke Riyaasati Majlis ne oos Tajwiiz ko dobaara manzur kiya tha, agar Riyaasati Shura ki, ki hui, ya ooski mashwara di hui ya jispar bhi Riyaasati Shura ne raza di thi, aesi taraameem ho tou, aur oon taraameem ko Riyaasati Majlis ne bhi raza di ho.
the Bill shall be deemed to have been passed by the Houses of the Legislature of the State in the form in which it was passed by the Legislative Assembly for the second time with such amendments, if any, as have been made or suggested by the Legislative Council and agreed to by the Legislative Assembly.

197(3). Is mazmoon ka koi bhi pehlu Maali Tajwiiz par laagu nahi ho sakta.
Nothing in this article shall apply to a Money Bill.

198. Maali Tajwizaat ke mutalliq makhsuus tariqa.—
Special procedure in respect of Money Bills.—

198(1). Riyaasaati Shura me Maali Tajwiiz ki ibteda nahi ki jaa sakti.
A Money Bill shall not be introduced in a Legislative Council.

198(2). Jis Riyaasat me Riyaasati Shura ho tou oos Riyaasat me Maali Tajwiiz ke Riyaasati Majlis me manzuur kiye jaane ke baad oose Riyaasati Shura me muntaqil kiya jaana hoga aur Riyaasati Shura oos Maali Tajwiiz ko haasil karne ki taarikh se chaudaah din ki muddat me oos Maali Tajwiiz ko apni sifaarishaat ke saath dobaara Riyaasati Majlis ko lauta dega aur Riyaasati Majlis chaahe tou Riyaasati Shura ki oon sifaarishaat me se tamaam ya kuch ko qubul ya radd kar sakta hae.
After a Money Bill has been passed by the Legislative Assembly of a State having a Legislative Council, it shall be transmitted to the Legislative Council for its recommendations, and the Legislative Council shall within a period of fourteen days from the date of its receipt of the Bill return the Bill to the Legislative Assembly with its recommendations, and the Legislative Assembly may thereupon either accept or reject all or any of the recommendations of the Legislative Council.

198(3). Agar Riyaasati Majlis Riyaasati ki kisi bhi sifaarish ko qubul kar le tou, oon taraameen ke saath jinki sifaarish Riyaasati Shura ne ki hou wo Maali Tajwiiz donohi Aewaan se manzuur shuda maani jaayegi.
If the Legislative Assembly accepts any of the recommendations of the Legislative Council, the Money Bill shall be deemed to have been passed by both Houses with the amendments recommended by the Legislative Council and accepted by the Legislative Assembly.

198(4). Agar Riyaasati Majlis Riyaasati Shura ki kisi bhi sifaarish ko qubul nahi kare tou, baghaer kisi aesi taraameen ke jiski sifaarish Riyaasati Shura ne ki ho aur oosi haalat me jaese oose Riyaasati Majlis me manzuur kiya gaya tha wo Maali Tajwiiz donohi Aewaan se manzur shuda maani jaayegi.
If the Legislative Assembly does not accept any of the recommendations of the Legislative Council, the Money Bill shall be deemed to have been passed by both Houses in the form in which it was passed by the Legislative Assembly without any of the amendments recommended by the Legislative Council.

198(5). Agar koi Maali Tajwiiz Riyaasati Majlis me manzuur ki jaane ke baad Riyaasati Shura me ooski sifaarishaat haasil karne ke liye muntaqil ki jaati hae aur bataayi gayi chaudaah din ki muddat ke darmeyaan dobaara Riyaasati Majlis ko lautaayi nahi jaati tou, oos muddat ke khatm ho jaane par oos Maali Tajwiiz ko oosi haalat me jaesa ke oose Riyaasati Majlis me manzuur kiya gaya tha oose donohi Aewaan se manzuur shuda maana jaaye ga.
If a Money Bill passed by the Legislative Assembly and transmitted to the Legislative Council for its recommendations is not returned to the Legislative Assembly within the said period of fourteen days, it shall be deemed to have been passed by both Houses at the expiration of the said period in the form in which it was passed by the Legislative Assembly.

199. “Maali Tajwizaat” ka khulaasa.—

Definition of “Money Bills”.—

199(1). Is baab ke maqaasid ke tehat, kisi bhi Tajwiiz ko Maali Tajwiiz maana jaayega agar oosme mehez darje zeel ma’amlaat me se tamaam ya kuch ke mutalliq usul hou, jaese ke:—
For the purposes of this Chapter, a Bill shall be deemed to be a Money Bill if it contains only provisions dealing with all or any of the following matters, namely:—

199(1a) kisi bhi zarb ko aaid karne, oosko khatm karne, oosme kami karne, oosme tabdiili karne ya oosko munazzim karne ke mutalliq hou;
the imposition, abolition, remission, alteration or regulation of any tax;

199(1b) Riyaasat ke maali karz lene ya koi zamaanat lene ki nizaamat ke mutalliq hou ya Riyaasat ki kisi bhi maaliyaati taqaazaat ki li gayi ya li jaane waali zimmedaari ke mutalliq hou;
the regulation of the borrowing of money or the giving of any guarantee by the State, or the amendment of the law with respect to any financial obligations undertaken or to be undertaken by the State;

199(1c) Riyaasat ke Maujmui Khazaane ya Hangaami Khazaane ki tehwiil ke mutaaliq hou, aesi kisi Khazaane me maal jama karne ya oosme se maal nikaalne ke mutalliq hou;
the custody of the Consolidated Fund or the Contingency Fund of the State, the payment of moneys into or the withdrawal of moneys from any such Fund;

199(1d) Riyaasat ke Majmui Khazaane me se maal ke tasarruf ke mutalliq hou;
the appropriation of moneys out of the Consolidated Fund of the State;

199(1e) kisi kharch ko Riyaasat ke Majmui Khazaane par aaid kharch you aelaan karne ke mutalliq hou ya aese kisi kharch ki raqam ko badhhaane ke mutalliq hou;
the declaring of any expenditure to be expenditure charged on the Consolidated Fund of the State, or the increasing of the amount of any such expenditure;

199(1f) Riyaasat ke Majmui Khazaane ke khaate me ya Riyaasat ke awaami khaate me maal jama karne ke mutalliq hou ya aese maal ki tehwiil ya oose ada karne ke mutalliq hou; ya
the receipt of money on account of the Consolidated Fund of the State or the public account of the State or the custody or issue of such money; or

199(1g) zere nukut (a) se lekar (f) tak me darj ma’amlaat se zimni kisi ma’amle ke mutalliq hou.
any matter incidental to any of the matters specified in subclauses (a) to (f).

199(2). Kisi bhi Tajwiiz ko mehez is bina par ke wo jurmanou ya digar jurmaanou ki saza ke mutalliq usul rakhti hou ya wo ijaazat naamou ke liye ya faraaham ki hui kisi khidmat ke aewaz raqam ka mutaalba ya raqam ki adaaegi ke mutalliq usul rakhti hou, ya wo ilaaqaayi maqaasid ke liye kisi ilaaqaayi mehkame ya idaare ke zariye kisi zarb ke aaid kiye jaane ke liye, oose khatm kiye jaane ke liye, oosme kami kiye jaane ke liye ya oosko munazzim kiye jaane ke liye koi usul rakhti hae tou, oos Tajwiiz ko Maali Tajwiiz nahi maana jayega.
A Bill shall not be deemed to be a Money Bill by reason only that it provides for the imposition of fines or other pecuniary penalties, or for the demand or payment of fees for licences or fees for services rendered, or by reason that it provides for the imposition, abolition, remission, alteration or regulation of any tax by any local authority or body for local purposes.

199(3). Agar ye sawaal uthhtaa hae ke koi Tajwiiz jise kisi Riyaasat ki Qaanuun-saaz majlis me pesh kiya gaya ho ke wo Maali Tajwiiz hae ya nahi tou, ispar oos Riyaasat ki Riyaasati Majlis ke Mukallim ka faesla hatami hoga.
If any question arises whether a Bill introduced in the Legislature of a State which has a Legislative Council is a Money Bill or not, the decision of the Speaker of the Legislative Assembly of such State thereon shall be final.

199(4). Har Maali Tajwiiz par, jab oose mazmoon 198 ke tehet Riyaasati Shura ko muntaqil kiya jaaye, aur jab mazmoon 198 ke tehet oos Maali Tajwiiz par Naazim e Riyaasat ki raza haasil karne ke liye oonke saamne pesh kiya jaaye tou, oos Maali Tajwiiz par sadaaqat naame ki tauseeq honi chaahiye, jis sadaaqat naame par Riyaasati Majlis ke Mukallim ne khud dastakhat karke ye tasdeeq ki ho ke wo ek Maali Tajwiiz hae.
There shall be endorsed on every Money Bill when it is transmitted to the Legislative Council under article 198, and when it is presented to the Governor for assent under article 200, the certificate of the Speaker of the Legislative Assembly signed by him that it is a Money Bill.

200. Tajwiizaat par Raza.—
Assent to Bills.—

Jab koi Tajwiiz Riyaasat ki Riyaasati Majlis se manzuur shuda ho chuki ho tou, ya agar kisi Riyaasat me Riyaasati Shura bhi ho tou, Riyaasat ki Qaanuun-saaz Majlis ke donohi Aewaan se manzuur shuda ho chuki ho tou, oos Tajwiiz ko Naazim e Riyaasat ke samne pesh kiya jaayega, aur Naazim e Riyaasat ye aelaan karenge ke oonhone oos Tajwiiz ko oonki raza de di hae, ya oonhone oos Tajwiiz par oonki raza ko rok li hae ya oonhone Sadar e Jamhuriya ki madde nazar ke liye oos Tajwiiz ko makhsus kar liya hae:
When a Bill has been passed by the Legislative Assembly of a State or, in the case of a State having a Legislative Council, has been passed by both Houses of the Legislature of the State, it shall be presented to the Governor and the Governor shall declare either that he assents to the Bill or that he withholds assent therefrom or that he reserves the Bill for the consideration of the President:

Shart ye hae ke, jab Naazim e Riyaasat ke saamne koi Tajwiiz ko oonki raza haasil karne ke liye pesh kiya gaya ho aur agar wo Maali Tajwiiz nahi hae tou Naazim e Riyaasat chaahe tou jald az jald oos Tajwiiz ko ek paighaam ke saath Aewaan ko ya donohi Aewaan ko lauta denge, aur paighaam me ye mashwara hoga ke oos Tajwiiz par ya ooske kisi waazae kiye gaye usul par dobaara ghaur o fikr ki jaaye, aur khususan aesi taraameen ki ibteda jinke wo khwaahismand ho aur paighaam me oonhone wazaahat ki hou onpar ghaur o fikr ki jaaye, aur jab is tarha se Tajwiiz ko lautaaya gaya hou tou, Aewaan ya dono Aewaan oos mutaabiiq Tajwiiz par dobaara ghaur o fikr karenge, aur agar Aewaan ya dono Aewaan oos Tajwiiz ko dobaara tarmeem ke saath ya tarmeen ke baghaer manzuur kar ke Naazim e Riyaasat ki raza haasil karne ke liye oonke saamne pesh kare tou, oos Tajwiiz par Naazim e Riyaasat oonki raza nahi rok sakte.
Provided that the Governor may, as soon as possible after the presentation to him of the Bill for assent, return the Bill if it is not a Money Bill together with a message requesting that the House or Houses will reconsider the Bill or any specified provisions thereof and, in particular, will consider the desirability of introducing any such amendments as he may recommend in his message and, when a Bill is so returned, the House or Houses shall reconsider the Bill accordingly, and if the Bill is passed again by the House or Houses with or without amendment and presented to the Governor for assent, the Governor shall not withhold assent therefrom:

Maziid Shart ye hae ke, aesi kisi Tajwiiz ko jo Naazime e Riyaasat ki raae me aesi hae ke, agar wo Tajwiiz qaanuun ban jaaye tou, wo Adaalat e Aalia ke ikhteyaaraat se is had alaahida ho jaayegi ke, is Aaain ke zariye oos Adaalat ko jis maqsad ko haasil karne ke liye qaayam kiya gaya tha, oosi mansab par khatra aawar hogi tou, aesi Tajwiiz ko Naazim e Riyaasat apni raza nahi denge, balqe oos Tajwiiz ko Sadar e Jamhuriya ki madde nazar ke liye makhsuus kar denge,
Provided further that the Governor shall not assent to, but shall reserve for the consideration of the President, any Bill which in the opinion of the Governor would, if it became law, so derogate from the powers of the High Court as to endanger the position which that Court is by this Constitution designed to fill.

201. Maade nazar ki garaz se makhsuus ki gayi Tajwiizaat.—
Bills reserved for consideration.—

Jab kisi Tajwiiz ko Naazim e Riyaasat Sadar e Jamhuriya ki madde nazar ke liye makhsuus kar de tou, Sadar e Jamhuriya ye aelaan karenge ke oonhone oos Tajwiiz ko oonki raza de di hae, ya oonhone oos Tajwiiz par oonki raza ko rok li hae:
When a Bill is reserved by a Governor for the consideration of the President, the President shall declare either that he assents to the Bill or that he withholds assent therefrom:

Shart ye hae ke, Jab Tajwiiz Maali Tajwiiz nahi ho tou, Sadar e Jamhuriya chaahe tou Naazim e Riyaasat ko ye hidaayat de sakte hae ke Naazim e Riyaasat oos Tajwiiz ko Aewaan ko lauta de ya, jaesa bhi ma’amla hou, Riyaasat ki Qaanuun-saaz Majlis ke donohi Aewaan ko lauta de, aese paighaam ke saath jiska zikr mazmoon 200 ke pehle usul me kiya gaya hae aur, jab oos Tajwiiz ko is tariqe se lautaaya gaya ho tou, oos Tajwiiz ko aese paighaam ke saath jis taarikh ko dobaara lauta gaya hou oos taarikh se che maah ki muddat ke darmeyaan, Aewaan ya donohi Aewaan oos Tajwiiz par oos mutaabiq dobaara ghaur o fikr karenge, aur agar oos Tajwiiz ko Aewaan ya donohi Aewaan dobaara tarmeem ke saath ya tarmeem ke baghaer manzur shuda kar de tou, oos Tajwiiz ko dobaara Sadar e Jamhuriya ke saamne oonki madde nazar ke liye pesh kiya jaayega.
Provided that, where the Bill is not a Money Bill, the President may direct the Governor to return the Bill to the House or, as the case may be, the Houses of the Legislature of the State together with such a message as is mentioned in the first proviso to article 200 and, when a Bill is so returned, the House or Houses shall reconsider it accordingly within a period of six months from the date of receipt of such message and, if it is again passed by the House or Houses with or without amendment, it shall be presented again to the President for his consideration.
