Disqualifications of Members


101. Maqaamaat ka khaali hona.—
Vacation of seats.—

101(1). Koi bhi shakhs Qaumi Majlis ke donohi Aewaan ka rukn nahi reh sakta aur Qaumi Majlis ko qaanuun ke zariye ye usul banana hoga taake kisi shakhs ko jo donohi Aewaan ka rukn chuna gaya ho ooska ya tou is Aewaan se ya tou oos Aewaan se maqaam khaali karaaya jaaye.
No person shall be a member of both Houses of Parliament and provision shall be made by Parliament by law for the vacation by a person who is chosen a member of both Houses of his seat in one House or the other.

101(2). Koi bhi shakhs Qaumi Majlis ka bhi aur kisi Riyaasati Majlis ke kisi Aewaan ka bhi in dono ka rukn nahi reh sakta, aur agar kisi shakhs ko Qaumi Majlis ka bhi aur kisi Riyaasati Majlis ke kisi Aewaan ka bhi in dono ka rukn chuna gaya ho tou, fir, Sadar e Jamhuriya ke zariye banaaye gaye qawaaid me waazae ki gayi muddat poori ho jaane ke baad, oos shakhs ka Qaumi Majlis me maqaam khaali ho jaaye ga, agar oos shakhs ne iske pehle hi Riyaasati Majlis ke apne maqaam se istefaa naa de diya ho.
No person shall be a member both of Parliament and of a House of the Legislature of a State, and if a person is chosen a member both of Parliament and of a House of the Legislature of a State, then, at the expiration of such period as may be specified in rules made by the President, that person’s seat in Parliament shall become vacant, unless he has previously resigned his seat in the Legislature of the State.

101(3). Agar Qaumi Majlis ke kisi bhi Aewaan ka koi rukn—
If a member of either House of Parliament—

101(3a). mazmoon 102 ke nukut (1) ya nukut (2) me zikr ki gayi kisi na-aehliyat ke tehet aajaaye to, ya
becomes subject to any of the disqualifications mentioned in clause (1) or clause (2) of article 102, or

101(3b). Amiir ya Mukallim, jaesa bhi ma’amla ho, oonko apni dastakhat shuda tehrir ke zariye apne maqaam se istefe ki ittela bhej de, aur ooska istefa Amiir ya Mukallim, jaesa bhi ma’amla ho, manzuur kar le, tou ooska maqaam fauran khaali ho jaaye ga:
resigns his seat by writing under his hand addressed to the Chairman or the Speaker, as the case may be, and his resignation is accepted by the Chairman or the Speaker, as the case may be, his seat shall thereupon become vacant:

Shart ye hae ke zere-nukut (b) me zikr kiye gaye istefe ke ma’amle me, agar ittela mil jaane ke baad ya digar zariye se ma’lumat haasil ho jaane ke baad aur oonhe jaesa munaasib lage waesi taftiish karaane ke baad, Amiir ya Mukallim, jaesa bhi ma’amla ho, agar wo mutmaiin ho jaate hae ke wo istefa khud ki marzi se nahi diya gaya tha ya jaali tha, tou wo aese istefa ko wo manzuur nahi karenge.
Provided that in the case of any resignation referred to in sub-clause (b), if from information received or otherwise and after making such inquiry as he thinks fit, the Chairman or the Speaker, as the case may be, is satisfied that such resignation is not voluntary or genuine, he shall not accept such resignation.

101(4). Agar koi rukn baghaer ijaazat ke Qaumi Majlis ke kisi bhi Aewaan ki tamaam nashistou se musalsal saath dinou ki muddat tak ghaer-haazir raha hou tou, Aewaan chaahe tou ooska maqaam khaali karaar de sakta hae:
If for a period of sixty days a member of either House of Parliament is without permission of the House absent from all meetings thereof, the House may declare his seat vacant:

Shart ye hae ke bataayegaye saath dinou ka hisaab lagaane me aesi kisi bhi muddat ko shumaar nahi kiya jaaye ga jab Aewaan ka chaar dino se zaaid ke liye ijlaas multawi ya nashist multawi ki gayi ho.
Provided that in computing the said period of sixty days no account shall be taken of any period during which the House is prorogued or is adjourned for more than four consecutive days.

102. Rukniyat ki na-aehliyat.—
Disqualifications for membership.—

102(1). Oos shakhs ko Qaumi Majlis ke kisi bhi Aewaan ke rukn chune jaane se, aur rukn hone se na-aehl kar diya jaaye ga—
A person shall be disqualified for being chosen as, and for being, a member of either House of Parliament—

102(1a). agar wo Hukumat e Hind ya kisi Riyaasat ki Hukumat ke tehat ki munaafe ke ohde par faaiz ho, siwaaye oon ohdou ke jinhe Qaumi Majlis ne qaanuun ke zariye aesa aelaan kiya ho ke ye wo ohde hae jinpar jo faaiz ho ye oonhe na-aehl nahi karte;
if he holds any office of profit under the Government of India or the Government of any State, other than an office declared by Parliament by law not to disqualify its holder;

102(1b). agar wo zehni taur se bimaar hou aur aesa oonhe is qabil kisi adaalat ne thehraaya ho;
if he is of unsound mind and stands so declared by a competent court;

102(1c). agar wo ek ghaer e bari diwaalia ho;
if he is an undischarged insolvent;

102(1d). agar wo Hind ka shehri nahi hae, ya oosne khud ki marzi se kisi digar Mulk ki shehriyat haasil kar li ho, ya kisi digar Mulk ka taslim shuda wafaadaar ya tarafdaar hae;
if he is not a citizen of India, or has voluntarily acquired the citizenship of a foreign State, or is under any acknowledgment of allegiance or adherence to a foreign State;

102(1e). agar oose Qaumi Majlis ke zariye banaaye gaye kisi bhi qaanuun ke zariye ya ooske tehat na-aehl kar diya gaya ho.
if he is so disqualified by or under any law made by Parliament.

Wazaahat.—Is mazmoon ke maqsad ke tehat kisi bhi shakhs ko sirf is bina par munaafe ke ohde par faaiz nahi maana jaayega ke wo Hukumat e Hind ya kisi Riyaasat ki Hukumat ke tehat Markaz me ya oos Riyaasat me Wazir hae.
Explanation.—For the purposes of this clause a person shall not be deemed to hold an office of profit under the Government of India or the Government of any State by reason only that he is a Minister either for the Union or for such State.

102(2). Agar kisi shakhs ko Daswi Fehrist ke tehat is mutalliq na-aehl maana gaya ho tou oose Qaumi Majlis ke kisi bhi Aewaan ka rukn hone se bhi na-aehl maana jaayega.
A person shall be disqualified for being a member of either House of Parliament if he is so disqualified under the Tenth Schedule.

103. Araakeen ki na-aehliyaat ke sawaalaat par faesla.—
Decision on questions as to disqualifications of members.—

103(1). Agar koi sawaal uthta hae ke Qaumi Majlis ke kisi bhi Aewaan ka koi rukn mazmoon 102 ke nukut (1) ke me zikr ki gayi kisi bhi na-aehliyaat ke tehat aata ho tou, faesle ke liye oos sawaal ko Sadar e Jamhuriya ki madde nazar kiya jaaye ga aur oonka faesla hatami hoga.
If any question arises as to whether a member of either House of Parliament has become subject to any of the disqualifications mentioned in clause (1) of article 102, the question shall be referred for the decision of the President and his decision shall be final.

103(2). Aese kisi sawaal par koi faesla dene se qabl, Sadar e Jamhuriya ko Intekhaabi Wafaz ki raae haasil karni hogi aur oonhe oos raae ke mutaabiq amal karna hoga.
Before giving any decision on any such question, the President shall obtain the opinion of the Election Commission and shall act according to such opinion.

104. Mazmoon 99 ke tehat halaf lene ya Aehad karne se qabl ya jab aehliyat na ho tou ya na-aehl kiye jaane ke baad baethhne aur raae dene ka jurmana.—
Penalty for sitting and voting before making oath or affirmation under article 99 or when not qualified or when disqualified.—

Koi shakhs mazmoon 99 ki sharaaet poori karne se qabl, ya jab oose ma’aluum ho ke wo is mutalliq na-aehl hae ya oosko rukn hone se na-aehl karaar diya gaya hae, ya ooske aesa karne par Qaumi Majlis ke banaaye gaye kisi qaanuun ke usul ke tehat mamnuhaat hae, agar wo Qaumi Majlis ke kisi bhi Aewan ke rukn ki haesiyat se baeththa ho aur raae di ho tou, har wo din jab wo baeththa ho aur raae di ho har din ke liye paanch sau rupaye jurmaana ada karne ka zimmedaar hae jise Markaz ki jaanib se diye gaye karz ke taur par oosse wasula jaayega.
If a person sits or votes as a member of either House of Parliament before he has complied with the requirements of article 99, or when he knows that he is not qualified or that he is disqualified for membership thereof, or that he is prohibited from so doing by the provisions of any law made by Parliament, he shall be liable in respect of each day on which he so sits or votes to a penalty of five hundred rupees to be recovered as a debt due to the Union.
