153. Naazimeen e Riyaasaat.—
Governors of States.—

Har Riyaasat ke ek Naazim e Riyaasat honge:
There shall be a Governor for each State:

Shart ye hae ke is mazmoon ka koi bhi pehlu ek hi shakhs ko do ya zaaid Riyaasaat ka Naazim e Riyaasat mukarrar kiye jaane nahi rokta.
Provided that nothing in this article shall prevent the appointment of the same person as Governor for two or more States.

154. Riyaasat ka amaliyaati ikhteyaar.—
Executive power of State.—

154(1). Riyaasat ka amaliyaati ikhteyaar Naazim e Riyaasat ke supurd hoga aur oon ihkteyaar par amal khud ba-zaat oonke kiya jaayega ya fir oonke naaeb afsaraan ke zariye kiya jaaye ga, aur wo amal is Aain ke mutaabiq hoga.
The executive power of the State shall be vested in the Governor and shall be exercised by him either directly or through officers subordinate to him in accordance with this Constitution.

154(2). Is mazmoon ke kisi bhi pehlu—
Nothing in this article shall—

154(2a). se ye nahi maana jaayega ke kisi bhi digar mohkam ko kisi bhi maujuda qaanuun ke zariye ata kiya gaya kisi a’amaal ko karne ka haq Naazim e Riyaasat ko muntaqil hoga; ya
be deemed to transfer to the Governor any functions conferred by any existing law on any other authority; or

154(2b). ke zariye Qaumi Majlis ya Riyaasat ki Majlis ko Naazim e Riyaasat ke maatehet kisi bhi digar mohkam par qaanuunan a’amal nafez karne se nahi roka ja sakta.
prevent Parliament or the Legislature of the State from conferring by law functions on any authority subordinate to the Governor.

155. Naazim e Riyaasat ka mukarrar kiya jaana.—
Appointment of Governor.—

Naazim e Riyaasat ko Sadar e Jamhuriya oonke dastakhat aur mohr shuda dastawez ke zariye mukarrar karenge.
The Governor of a State shall be appointed by the President by warrant under his hand and seal.

156. Naazim e Riyaasat ke ohde ki muddat.—
Term of office of Governor.—

156(1). Naazim e Riyaasat apne ohde par tab tak hi qaayam rahenge jab tak ke Sadar e Jamhuriya ki raza ho.
The Governor shall hold office during the pleasure of the President.

156(2). Naazim e Riyaasat chaahe tou, wo kisi bhi waqt, apne dastakhat ke tehat Sadar e Jamhuriya ko di gayi apni tehriir ke zariye, apne ohde se istefa de sakte hae.
The Governor may, by writing under his hand addressed to the President, resign his office.

156(3). Is mazmoon ke zere zikr usul ke tehet rehte hue, Naazim e Riyaasat jis taarikh se apne ohde par faaez honge us taarikh se lekar paanch saal ki muddat tak apne ohde par faaez rahenge:
Subject to the foregoing provisions of this article, a Governor shall hold office for a term of five years from the date on which he enters upon his office:

Shart ye hae keNaazim e Riyaasat, ape ohde ki muddat ke khatm ho jaane ke baawajood, apne ohde par faaez rahenge jab tak ke unke jaanasheen ohde par khud faaez nahi ho jaate.
Provided that a Governor shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon his office.

157. Naazim e Riyaasat mukarrar kiye jaane ki aehliyat.—
Qualifications for appointment as Governor.—

Kisi bhi shakhs Naazim e Riyaasat mukarrar kiye jaane ke liye aehl tab’hi maana jaaye ga jab wo Hind ka shehri hoga aur oosne paetiis saal ki umr mukammil kar li hogi.
No person shall be eligible for appointment as Governor unless he is a citizen of India and has completed the age of thirty-five years.

158. Naazim e Riyaasat ke ohde ki sharaaet.—
Conditions of Governor's office.—

158(1). Naazim e Riyaasat Qaumi Majlis ke done me se kisi bhi Aewaan ke rukn nahi ho sakte, aur kisi bhi aesi Riyaasat jo Pehli Fehrist me darj hae ooski Qaanuun-Saaz Majlis ke kisi bhi Aewaan ke rukn nahi ho sakte, aur agar Qaumi Majlis ke dono me se kisi bhi Aewaan ke kisi rukn ko ya kisi bhi Riyaasat ki Qaanuun-Saaz Majlis ke kisi bhi Aewaan ke kisi rukn ko Naazim e Riyaasat muntakhib kiya jaata hae tou, ye maana jaayega ke onhone oos Aewaan jiske wo rukn the waaha se apni rukniyat ko oos taarikh ko tarq kar diya jis din wo Naazim e Riyaasat ke ohde par faaez honge.
The Governor shall not be a member of either House of Parliament or of a House of the Legislature of any State specified in the First Schedule, and if a member of either House of Parliament or of a House of the Legislature of any such State be appointed Governor, he shall be deemed to have vacated his seat in that House on the date on which he enters upon his office as Governor.

158(2). Naazim e Riyaasat digar kisi bhi munaafe ke ohde par faaez nahi ho sakte.
The Governor shall not hold any other office of profit.

158(3). Naazim e Riyaasat ka ye haq hoga ke wo kiraaye ki adaayagi ke baghaer apni tamaam Sarkaari Rihaayish ka ist’emaal kar sakte hae aur saath hi aese munaafe, tankhwaah aur imtiyaazaat ko haasil kar sakte hae jise Qaumi Majlis ne qanuun ke zariye mutayyin kiya ho, jab tak ke is mutalliq usul tayyar nahi kar diya jaate, tab tak aese munaafou, tankhwaah aur imtiyaazaat wo honge jo Dusri Fehrist me darj hae.
The Governor shall be entitled without payment of rent to the use of his official residences and shall be also entitled to such emoluments, allowances and privileges as may be determined by Parliament by law and, until provision in that behalf is so made, such emoluments, allowances and privileges as are specified in the Second Schedule.

158(3A). Jab ek hi shakhs ko do ya zaaid Riyaasaat ka Naazim e Riyaasat mukarrar kiya jaye tou, Naazim e Riyaasat ko ada karda munaafe aur tankhwaah ko oon Riyaasaat ke darmeyaan aesi nisbat ke saath taqsiim kiya jaayega jaesi ke Sadar e Jamhuriya oonke hukm ke zariye mutayyin karenge.
Where the same person is appointed as Governor of two or more States, the emoluments and allowances payable to the Governor shall be allocated among the States in such proportion as the President may by order determine.

158(4). Naazim e Riyaasat ke ohde ki muddat ke dauraan oonke munaafe aur tankhwaah ko kam nahi kiya jaa sakta.
The emoluments and allowances of the Governor shall not be diminished during his term of office.

159. Naazim e Riyaasat ke Ohde ki Qubuliyat ki halaf.—
Oath or affirmation by the Governor.—

Har Naazim e Riyaasat ko aur har wo shakhs jo Naazim e Riyaasat ke ikhteyaaraat ki takmiil kar rahe ho tou oonhe, wo Riyaasat jis Adaalat e Aalia ke daaeraye ikhteyaar me ho ooske Qaazi e Aala ki maujudgi me, agar wo maujud na ho tou fir oos Adaalat e Aalia ke aehem-tariin Qaazi jo maujud hou to unki maujudgi me, apne ohde par faaez hone se qabl, Halaf lena ya Aehad karna hoga aur dastekhat karna hoga, is tariqe se—
Every Governor and every person discharging the functions of the Governor shall, before entering upon his office, make and subscribe in the presence of the Chief Justice of the High Court exercising jurisdiction in relation to the State, or, in his absence, the senior most Judge of that Court available, an oath or affirmation in the following form, that is to say—

“Mae, A.B., ‘Khuda ki Qasam leta hu/ pukhta aehed leta hu’ ke mae mukammil imaandaari ke saath ......... (Riyaasat ka naam) ke Naazim e Riyaasat ke ohde ko munazzim karunga [ya ......... (Riyaasat ka naam) ke Naazim e Riyaasat ke a’amaal ki takmiil karunga], aur apni mukammil salaahiyaat ke zariye Aain aur Qaanuun ki nigeh-baani, tahhaffuz aur inki difaa karunga aur mai apne aap ko ..…… (Riyaasat ka naam) ki awaam ki khidmat aur bhalaayi ke liye waqf kar dunga.”
“I, A. B., do swear in the name of God/ solemnly affirm that I will faithfully execute the office of Governor (or discharge the functions of the Governor) of .........(name of the State) and will to the best of my ability preserve, protect and defend the Constitution and the law and that I will devote myself to the service and well-being of the people of ..……(name of the State).”

160. Ba’az Naagahaani haalat ke dauraan Naazim e Riyaasat ke a’amaal ki takmiil.—
Discharge of the functions of the Governor in certain contingencies.—

Is baab me tazkira nahi kiye gaye kisi bhi naagahaani haalat ke dauraan kisi Riyaasat ke Naazim e Riyaasat ke a’amaal ki takmiil ke mutalliq Sadar e Jamhuriya aese usul qaayam kar sakte hae jaesa ke wo munaasib samjhe.
The President may make such provision as he thinks fit for the discharge of the functions of the Governor of a State in any contingency not provided for in this Chapter.

161. Naazim e Riyaasat ka me ma’afi, waghaera dene ka ikhteyaar, aur baaz muqaddamaat ke faeslou ko ma’atal karne ka, radd karne ka ya onki saza ko kam karne ka haq.—
Power of Governor to grant pardons, etc., and to suspend, remit or commute sentences in certain cases.—

Naazim e Riyaasat ko darj e zeel ma’amle me saza me ma’afi dene ka, osko ma’atal karne ka, osme mohlat dene ya oosko kam karne ka ikhteyaar hae ya darj e zeel ma’amle ke kisi bhi jurm me mujrim thhehraaye gaye kisi shakhs ke oopar sunaaye gaye faesle ko ma’atal karne ka, osko radd karne ka ya oski saza ko kam karne ka ikhteyaar hae, aesa ma’amla jispar oos Riyaasat ke amaliyaati ikhteyaar laagu hote hae—
The Governor of a State shall have the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the State extends.

162. Riyaasat ke amaliyaati ikhteyaar ki had.—
Extent of executive power of State.—

Is Aain ke usul ke tehat, Riyaasat ke amaliyaati ikhteyaar ki had oon tamaam ma’amlaat me laagu hogi jinme Riyaasat ki Qaanuun-saaz Majlis ko qaanuun-saazi ke ikhteyaar hae:
Subject to the provisions of this Constitution, the executive power of a State shall extend to the matters with respect to which the Legislature of the State has power to make laws:

Shart ye hae ke aese kisi bhi ma’amle ke mutalliq jisme Riyaasat ki Majlis aur Qaumi Majlis dono hi ko qaanuun-saazi ke ikhteyaar hae, oosme Riyaasat ke amaliyaat ikhteyaar Markaz ya ooske kisi mohkam ko is Aain ya Qaumi Majlis ke banaaye gaye kisi qaanuun ke zariye waazae taur par ata kiye gaye amaliyaati ikhteyaar ke tehet honge aur oosi ke mutaabiq mehduud honge.
Provided that in any matter with respect to which the Legislature of a State and Parliament have power to make laws, the executive power of the State shall be subject to, and limited by, the executive power expressly conferred by this Constitution or by any law made by Parliament upon the Union or authorities thereof.
